2. Allgemeines zur Datenverarbeitung

Ich verarbeite personenbezogene Daten der Nutzer grundsätzlich nur, soweit dies zur Bereitstellung einer funktionsfähigen Website sowie meiner Inhalte und Leistungen erforderlich ist. Die Verarbeitung erfolgt regelmäßig nur nach Einwilligung der Nutzer oder soweit eine Rechtsgrundlage die Verarbeitung gestattet.

3. Hosting und Server-Logfiles

Diese Website wird auf einem Server der Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Deutschland, in einem Rechenzentrum in Deutschland gehostet. Bei jedem Aufruf erhebt und speichert der Server automatisch Informationen in sogenannten Server-Logfiles, die Ihr Browser übermittelt:

• anonymisierte bzw. gekürzte IP-Adresse
• Datum und Uhrzeit des Zugriffs
• aufgerufene URL / Name der abgerufenen Datei
• Referrer-URL
• verwendeter Browser und Betriebssystem

Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO. Mein berechtigtes Interesse liegt in der technischen Bereitstellung, der Sicherheit und Stabilität der Website. Die Logfiles werden nach kurzer Zeit gelöscht, soweit sie nicht zur Aufklärung von Missbrauch oder Störungen benötigt werden. Mit Hetzner besteht ein Vertrag zur Auftragsverarbeitung (Art. 28 DSGVO).

4. Kontaktformular und Kontakt per E-Mail

Wenn Sie mir über das Kontaktformular oder per E-Mail Anfragen zukommen lassen, werden die von Ihnen gemachten Angaben zum Zweck der Bearbeitung der Anfrage verarbeitet. Über das Formular erhebe ich:

• Name
• E-Mail-Adresse
• Ihre Nachricht
• Datum/Uhrzeit sowie die IP-Adresse des Absenders (zur Missbrauchs- und Spam-Vermeidung; anders als bei den Server-Logfiles wird sie hier ungekürzt gespeichert und spätestens nach 30 Tagen gelöscht)

Die Nachricht wird per verschlüsselter SMTP-Verbindung an mein E-Mail-Postfach beim E-Mail-Dienst der Hetzner Online GmbH zugestellt. Rechtsgrundlage für die Verarbeitung ist bei vorvertraglichen bzw. vertraglichen Anliegen Art. 6 Abs. 1 lit. b DSGVO, im Übrigen mein berechtigtes Interesse an der Beantwortung Ihrer Anfrage nach Art. 6 Abs. 1 lit. f DSGVO. Die Daten werden gelöscht, sobald sie für die Erreichung des Zweckes nicht mehr erforderlich sind und keine gesetzlichen Aufbewahrungspflichten entgegenstehen.

5. Schriftarten (lokal gehostet)

Diese Website verwendet Schriftarten („Space Grotesk", „Hanken Grotesk", „JetBrains Mono", „Wallpoet"), die lokal auf dem Server gespeichert sind und von dort ausgeliefert werden. Es wird keine Verbindung zu Servern Dritter (etwa Google Fonts) aufgebaut; es werden dabei keine personenbezogenen Daten an Dritte übertragen.

6. Cookies und lokale Speicherung

Diese Website setzt keine Tracking- oder Marketing-Cookies ein. Zur Speicherung Ihrer bevorzugten Anzeigesprache (DE/EN) wird ausschließlich der lokale Speicher Ihres Browsers („localStorage") genutzt. Diese Information verbleibt auf Ihrem Gerät und wird nicht an mich übertragen. Die Speicherung ist unbedingt erforderlich, damit die Seite in der von Ihnen gewählten Sprache erscheint; sie erfolgt daher ohne Einwilligung nach § 25 Abs. 2 Nr. 2 TDDDG. Sie können den lokalen Speicher jederzeit über die Einstellungen Ihres Browsers löschen.

7. Duktus-App und Duktus Cloud

Diese Erklärung umfasst auch die App „Duktus". Duktus ist „local-first": Ihre Notizen, Aufgaben-, Planer- und Kalenderdaten werden standardmäßig ausschließlich lokal auf Ihrem Gerät gespeichert. Ohne Ihr Zutun werden keine Inhalte an mich oder Dritte übertragen.

a) Optionale Synchronisierung („Duktus Cloud")

Wenn Sie die optionale Duktus-Cloud-Synchronisierung nutzen, wird ein Konto mit Ihrer E-Mail-Adresse und einem (als Argon2id-Hash gespeicherten) Passwort angelegt. Ihre synchronisierten Inhalte (Notizen, Aufgaben, Planer, Notizbücher) und etwaige Datei-Anhänge werden zum Zweck des Geräteabgleichs auf der Infrastruktur von Cloudflare (Cloudflare Workers, D1-Datenbank, R2-Speicher) verarbeitet und gespeichert. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO (Bereitstellung der von Ihnen angeforderten Funktion).

Cloudflare handelt dabei als Auftragsverarbeiter; mit Cloudflare, Inc. (101 Townsend St, San Francisco, CA 94107, USA) besteht ein Auftragsverarbeitungsvertrag nach Art. 28 DSGVO. Cloudflare betreibt ein weltweites Netz, sodass eine Verarbeitung auch außerhalb der Europäischen Union — insbesondere in den USA — stattfinden kann. Cloudflare, Inc. ist unter dem EU-US Data Privacy Framework zertifiziert; ergänzend sind die Standardvertragsklauseln der EU-Kommission nach Art. 46 Abs. 2 lit. c DSGVO vereinbart.

Auch bei aktivierter Ende-zu-Ende-Verschlüsselung fallen auf dem Server unvermeidbare Metadaten an: Ihre E-Mail-Adresse, der Passwort-Hash, Zeitstempel der letzten Änderung, die Anzahl und Größe der Datensätze und Anhänge, Ihr Tarif sowie technische Angaben zu Ihren angemeldeten Geräten. Inhalte selbst sind davon nicht umfasst.

b) Ende-zu-Ende-Verschlüsselung (E2EE)

Auf Wunsch aktivieren Sie die Ende-zu-Ende-Verschlüsselung. Ihre Inhalte werden dann bereits auf Ihrem Gerät mit einer nur Ihnen bekannten Passphrase verschlüsselt; auf dem Server liegen dann ausschließlich verschlüsselte Daten, die weder ich noch der Betreiber der Server- Infrastruktur lesen können. Ohne Passphrase bzw. Wiederherstellungsschlüssel sind die Inhalte nicht wiederherstellbar.

c) Kalender-Synchronisierung (CalDAV)

Nutzen Sie den Kalender mit CalDAV (z. B. Nextcloud), verbindet sich die App direkt mit dem von Ihnen angegebenen Server; eine Vermittlung über meine Systeme findet nicht statt. Zugangsdaten werden ausschließlich im Schlüsselbund Ihres Betriebssystems gespeichert.

d) Löschung

Sie können Ihr Duktus-Cloud-Konto samt aller serverseitig gespeicherten Daten jederzeit in der App löschen. Dabei werden Ihr Konto, alle angemeldeten Sitzungen, sämtliche synchronisierten Datensätze und alle Datei-Anhänge unmittelbar und unwiderruflich entfernt. Technisch bedingt kann der Datenbankdienst noch bis zu 30 Tage lang automatische Wiederherstellungspunkte vorhalten, die anschließend überschrieben werden; darauf wird nur im Störungsfall zurückgegriffen.

Solange Sie Ihr Konto nicht löschen, bleiben die synchronisierten Daten gespeichert, damit sie auf Ihren Geräten verfügbar bleiben — eine automatische Löschung nach Zeitablauf findet nicht statt. Es findet kein Tracking und keine Weitergabe an Dritte zu Werbezwecken statt.

e) Bezahlung von Duktus Pro

Für das kostenpflichtige Abonnement werden Zahlungsdaten nicht von mir, sondern vom jeweiligen Verkäufer verarbeitet: Bei einem Kauf im Mac App Store ist das Apple, bei einem Kauf über die Website die Paddle.com Market Ltd. (Judd House, 18–29 Mora Street, London EC1V 8BT, Vereinigtes Königreich) als Merchant of Record. Ich erhalte keine vollständigen Zahlungsdaten. Zur Freischaltung Ihres Tarifs erhalte ich von diesen Anbietern lediglich die Information, dass für Ihr Konto ein gültiges Abonnement besteht, sowie eine Vorgangskennung und das Ablaufdatum; diese Angaben werden Ihrem Duktus-Cloud-Konto zugeordnet. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO.

8. Ihre Rechte als betroffene Person

Ihnen stehen nach der DSGVO folgende Rechte zu:

• Auskunft über die zu Ihrer Person gespeicherten Daten (Art. 15 DSGVO)
• Berichtigung unrichtiger Daten (Art. 16 DSGVO)
• Löschung (Art. 17 DSGVO)
• Einschränkung der Verarbeitung (Art. 18 DSGVO)
• Datenübertragbarkeit (Art. 20 DSGVO)
• Widerspruch gegen die Verarbeitung (Art. 21 DSGVO)
• Widerruf einer erteilten Einwilligung mit Wirkung für die Zukunft (Art. 7 Abs. 3 DSGVO)

9. Beschwerderecht bei der Aufsichtsbehörde

Unbeschadet eines anderweitigen verwaltungsrechtlichen oder gerichtlichen Rechtsbehelfs steht Ihnen ein Beschwerderecht bei einer Datenschutz-Aufsichtsbehörde zu, insbesondere in dem Mitgliedstaat Ihres Aufenthaltsorts, Ihres Arbeitsplatzes oder des Orts des mutmaßlichen Verstoßes.

10. Aktualität und Änderung dieser Datenschutzerklärung

Diese Datenschutzerklärung ist aktuell gültig. Durch die Weiterentwicklung der Website oder aufgrund geänderter gesetzlicher bzw. behördlicher Vorgaben kann es notwendig werden, diese Erklärung anzupassen.

2. General information on data processing

As a rule, I process users' personal data only to the extent necessary to provide a functioning website as well as my content and services. Processing regularly takes place only with the user's consent or where a legal basis permits the processing.

3. Hosting and server log files

This website is hosted on a server operated by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany, in a data centre located in Germany. Each time the site is accessed, the server automatically collects and stores information in so-called server log files, which your browser transmits:

• anonymised or truncated IP address
• date and time of access
• URL accessed / name of the file retrieved
• referrer URL
• browser and operating system used

The legal basis is Art. 6 (1) (f) GDPR. My legitimate interest lies in the technical provision, security and stability of the website. The log files are deleted after a short period, unless they are required to investigate misuse or malfunctions. A data processing agreement (Art. 28 GDPR) is in place with Hetzner.

4. Contact form and contact by email

If you send me enquiries via the contact form or by email, the information you provide is processed for the purpose of handling the enquiry. Via the form I collect:

• name
• email address
• your message
• date/time as well as the sender's IP address (to prevent misuse and spam; unlike the server log files it is stored in full here and deleted after 30 days at the latest)

The message is delivered via an encrypted SMTP connection to my mailbox with the email service of Hetzner Online GmbH. The legal basis for the processing is Art. 6 (1) (b) GDPR for pre-contractual or contractual matters, and otherwise my legitimate interest in responding to your enquiry pursuant to Art. 6 (1) (f) GDPR. The data is deleted as soon as it is no longer required to achieve the purpose and no statutory retention obligations prevent deletion.

5. Fonts (locally hosted)

This website uses fonts (“Space Grotesk”, “Hanken Grotesk”, “JetBrains Mono”, “Wallpoet”) that are stored locally on the server and delivered from there. No connection to third-party servers (such as Google Fonts) is established; no personal data is transmitted to third parties in this context.

6. Cookies and local storage

This website does not use any tracking or marketing cookies. To store your preferred display language (DE/EN), only your browser's local storage (“localStorage”) is used. This information remains on your device and is not transmitted to me. Storing it is strictly necessary for the page to appear in the language you chose and therefore requires no consent, pursuant to § 25 (2) no. 2 TDDDG (German Telecommunications Digital Services Data Protection Act). You can clear local storage at any time in your browser settings.

7. The Duktus app and Duktus Cloud

This policy also covers the “Duktus” app. Duktus is “local-first”: your notes, tasks, planner and calendar data are by default stored exclusively locally on your device. No content is transmitted to me or to third parties without action on your part.

a) Optional synchronisation (“Duktus Cloud”)

If you use the optional Duktus Cloud synchronisation, an account is created with your email address and a password (stored as an Argon2id hash). Your synchronised content (notes, tasks, planner, notebooks) and any file attachments are processed and stored on the infrastructure of Cloudflare (Cloudflare Workers, D1 database, R2 storage) for the purpose of synchronising your devices. The legal basis is Art. 6 (1) (b) GDPR (provision of the function you requested).

Cloudflare acts as a processor; a data processing agreement pursuant to Art. 28 GDPR is in place with Cloudflare, Inc. (101 Townsend St, San Francisco, CA 94107, USA). Cloudflare operates a global network, so processing may also take place outside the European Union, in particular in the USA. Cloudflare, Inc. is certified under the EU-US Data Privacy Framework; in addition, the European Commission's Standard Contractual Clauses pursuant to Art. 46 (2) (c) GDPR have been agreed.

Even with end-to-end encryption enabled, some metadata is unavoidable on the server: your email address, the password hash, timestamps of the last change, the number and size of records and attachments, your plan, and technical details of the devices you signed in with. Content itself is not included.

b) End-to-end encryption (E2EE)

You may optionally activate end-to-end encryption. Your content is then encrypted on your device with a passphrase known only to you; the server then holds exclusively encrypted data, which neither I nor the operator of the server infrastructure can read. Without the passphrase or the recovery key, the content cannot be restored.

c) Calendar synchronisation (CalDAV)

If you use the calendar with CalDAV (e.g. Nextcloud), the app connects directly to the server you specify; there is no intermediation via my systems. Access credentials are stored exclusively in your operating system's keychain.

d) Deletion

You can delete your Duktus Cloud account, including all data stored on the server, at any time in the app. This immediately and irreversibly removes your account, all signed-in sessions, every synchronised record and all file attachments. For technical reasons the database service may retain automatic recovery points for up to 30 days, which are then overwritten; they are only used in the event of a fault.

As long as you do not delete your account, the synchronised data remains stored so that it stays available on your devices — there is no automatic deletion after a period of time. There is no tracking and no disclosure to third parties for advertising purposes.

e) Paying for Duktus Pro

For the paid subscription, payment data is not processed by me but by the respective seller: for a purchase in the Mac App Store that is Apple, and for a purchase via the website it is Paddle.com Market Ltd. (Judd House, 18–29 Mora Street, London EC1V 8BT, United Kingdom) acting as merchant of record. I never receive complete payment details. To unlock your plan, those providers only tell me that a valid subscription exists for your account, along with a transaction reference and the expiry date; this information is linked to your Duktus Cloud account. The legal basis is Art. 6 (1) (b) GDPR.

8. Your rights as a data subject

Under the GDPR you have the following rights:

• access to the data stored about you (Art. 15 GDPR)
• rectification of inaccurate data (Art. 16 GDPR)
• erasure (Art. 17 GDPR)
• restriction of processing (Art. 18 GDPR)
• data portability (Art. 20 GDPR)
• objection to the processing (Art. 21 GDPR)
• withdrawal of consent given, with effect for the future (Art. 7 (3) GDPR)

9. Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, place of work or the place of the alleged infringement.

10. Validity and amendment of this privacy policy

This privacy policy is currently valid. Due to the further development of the website or because of changed statutory or regulatory requirements, it may become necessary to amend this policy.

This English version is a convenience translation. In case of any discrepancy, the German version is authoritative.
